CONTRACTUAL STATUTORY/COMMON LAW TERMS AND CONDITIONS (trader is also known as the "manufacturer")

1. The following implied statutory warranties are incorporated into this contract:

(a) The services rendered by the manufacturer to the consumer shall be exercised with due care and skill (S74 of the Trade Practices Act "TPA").
(b) The materials used in the manufacture of the designed product shall be reasonably fit for the deemed practical purpose based on the consumers requirements made known to the manufacturer at the time that the order is placed by the consumer (S74 TPA).
(c) The materials supplied in connection with those services will be reasonably fit for that purpose and will be of such nature and quality that might reasonably be expected in achieving the desired result except where the circumstances show that the customer does not rely or that it is unreasonable for the said customer/s to rely on the manufacturers skill and judgement (S74 TPA).
(d) It is implied that the supply of the said goods so described in this contract are of "merchantable quality" (S74 TPA).
(e) The customer/consumer shall not make the inference that the goods supplied merely because of fair wear and tear and especially if the goods are not used for the intended purpose and that the goods are abused or unreasonably misused and contrary to the manufacturers specific instructions are faulty. The manufacturer/trader shall not be held liable at law if the goods manufactured and supplied are installed incorrectly by a qualified trades person.

2. The manufacturer will not be held liable (notwithstanding the part manufactured and sold as new and as per the customers specifications) for the parts incorrect assembly together with other parts that are either faulty/defective or inappropriate in relation to the co-assembly of the part/s sold to the customer.

3. All products/parts are covered by the manufacturers guarantee of quality against faulty manufacturer or workmanship for a period of six (6) months from the date of purchase notwithstanding any implied statutory warranties.

4. Initially Transmission components are guaranteed to select gears and not distribute unusual noise and enhance unusual premature fair wear and tear.

5. The customer shall pay for all postage and handling in relation to any warranty claims made by interstate, intrastate and international customers.

6. The manufacturer does not assemble and is not responsible for the assembly, re-assembly and installation of any parts manufactured.

7. The manufacturer / Designer, after inspection, shall have the ultimate or sole discretion to refuse to accept any transmission for guarantee repair work.
